01Acceptance of Terms

By accessing or using fitcue, you agree to these Terms of Service. If you do not agree, you may not use the app.

02About fitcue

fitcue provides outfit analysis and style feedback based on photos and information you choose to submit. The feedback is for informational and personal use only. fitcue does not provide professional, medical, safety, employment, legal, or other regulated advice.

03Eligibility

You must be at least 13 years old to use fitcue. If you are under the age of majority where you live, you may use fitcue only with permission from a parent or legal guardian.

04User Content

You may upload photos and related information to receive outfit feedback. You retain ownership of the content you upload. By uploading content, you grant fitcue a limited license to process, analyze, display, and transmit that content solely as needed to operate, maintain, improve, and protect the service.

You are responsible for the content you upload. You may not upload content that is illegal, harmful, offensive, sexually explicit, invasive of another person’s privacy, or that infringes another person’s rights.

05Photo Processing and Privacy

Photos and other information you provide may be processed to generate outfit analysis and style feedback. We do not sell your photos. We retain uploaded photos only as long as reasonably necessary to provide the service, maintain safety and security, comply with legal obligations, or as described in our Privacy Policy.

Please review our Privacy Policy for more information about what data we collect, how we use it, how long we keep it, and how you can request deletion.

06Credits, Purchases, and Subscriptions

fitcue may offer free credits, paid credits, or subscription plans. Credits allow you to access outfit analysis features. Subscription plans may provide a set number of credits or other benefits during each billing period.

Credits may expire, may not roll over between billing periods, and may be subject to limits described in the app at the time of purchase. Unless required by law or Apple’s policies, unused credits are not refundable or redeemable for cash.

07Apple In-App Purchases

Purchases and subscriptions made through the iOS app are processed by Apple through your Apple Account. If you purchase an auto-renewable subscription, it will automatically renew unless you cancel it at least 24 hours before the end of the current billing period.

You can manage or cancel your subscription in your Apple Account settings. Billing, refunds, and payment issues for Apple in-app purchases are handled by Apple according to Apple’s terms and policies.

08Cancellation Policy

You may cancel your subscription at any time through your Apple Account settings. Cancellation will take effect at the end of your current billing period. You will continue to have access to subscription features and any included credits until the end of that billing period, unless otherwise stated in the app.

Deleting the fitcue app does not cancel your subscription. To avoid future charges, you must cancel your subscription through Apple at least 24 hours before the end of the current billing period.

09Refund Policy

Purchases and subscriptions made through the iOS app are processed by Apple. Refund requests for App Store purchases must be submitted to Apple and are handled according to Apple’s refund policies.

Except where required by law or Apple’s policies, purchases, subscription fees, and unused credits are non-refundable and not redeemable for cash.

10Acceptable Use

You agree not to misuse fitcue, including by:

• violating any law or regulation;
• uploading content you do not have the right to use;
• attempting to reverse engineer, disrupt, or overload the service;
• using automated tools to access the service without permission;
• using fitcue to harass, harm, impersonate, or exploit others;
• attempting to bypass credit, subscription, or access limits.

11Automated Feedback

fitcue may use automated systems to provide outfit analysis and style feedback. The feedback may be inaccurate, incomplete, subjective, or unsuitable for your particular circumstances. You are responsible for deciding whether and how to use any feedback provided by fitcue.

12Service Availability

We may modify, suspend, or discontinue any part of fitcue at any time. We do not guarantee that the service will always be available, uninterrupted, secure, or error-free.

13Account Deletion

If fitcue allows account creation, you may request deletion of your account and associated personal data through the app or by contacting us at support@getfitcue.app. Some information may be retained where necessary for legal, security, fraud prevention, billing, or legitimate business purposes.

14Intellectual Property

fitcue, including its design, software, branding, and content, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of fitcue unless we give you written permission.

15Disclaimer of Warranties

fitcue is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, fitness for a particular purpose, merchantability, and non-infringement.

16Limitation of Liability

To the fullest extent permitted by law, fitcue and its owners, operators, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or other intangible losses arising from your use of the service.

17Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the app or by other reasonable means. Your continued use of fitcue after the updated Terms become effective means you accept the updated Terms.
